- Can a custodial parent receive child support and welfare at the same time?
- No. If a custodial parent is receiving public assistance; the custodial parent is then ineligible for child support. Upon approval of welfare assistance the custodial parent automatically waives his/her right to child support.
The Department of Public Health and Social Services will route a referral to Guam's child support enforcement agency and we will obtain child support as reimbursement for welfare assistance against the non-custodial parent.
However, once a child is no longer eligible for welfare, the custodial parent may be able to receive child support from the non-custodial parent for the ineligible child, but if any other children of the couple are still on welfare, welfare may be reduced.
